
BOISE — Idaho Attorney General Raúl Labrador and Ada County Sheriff Matt Clifford have notified Boise Mayor Lauren McLean that the city’s current flag display violates a new state law restricting which flags may fly on government property.
As of this week, Boise City Hall continues to display a Pride flag and a donor awareness flag, along with permitted flags such as the U.S., Idaho, and POW/MIA flags. Under House Bill 96, non-government or non-military flags are not authorized for display on public buildings.
In a letter to the mayor, Labrador stated the city is not complying with the law, which took effect April 3. The statute does not currently include penalties, but legislative leaders have indicated they may introduce enforcement measures next session — including the option to withhold state sales tax revenue from non-compliant entities.
City officials said they are reviewing the law’s scope and will continue to fly the current flags in the meantime.
