A national Christian legal advocacy organization is working alongside attorneys for Idaho and West Virginia as the states defend their laws restricting transgender athletes from competing in girls sports.
The organization’s lawyers have been collaborating with state solicitor generals as the cases move through the US Supreme Court. Both states are defending statutes that define participation in girls sports based on biological sex.
Organization’s Background and Recent Supreme Court Activity
The group, based in Arizona, began as a legal defense fund focused on religious liberty and conservative causes. In recent years, it has become a regular presence before the nation’s highest court.
During the current Supreme Court term, the organization has already appeared in two other cases. One involved a challenge to a state law regulating conversion therapy. The other involved a dispute over a subpoena seeking donor information from a faith-based pregnancy center, with attorneys arguing the request violated First Amendment protections.
Role in the Transgender Sports Cases
In the Idaho and West Virginia matters, the organization is not only advising state attorneys but also representing an additional student connected to the West Virginia case.
That student, a 17-year-old classmate of Becky Pepper-Jackson, submitted a filing to the court stating she became discouraged after losing a spot in a 2023 sports competition. She said she initially placed ahead of Pepper-Jackson but was later beaten in the same event.
The student also alleged that inappropriate remarks made in a middle school locker room caused her to feel fearful.
Disputed Allegations and School Review
Pepper-Jackson has denied the accusations. According to a letter from the school system’s attorney, an internal investigation found that the claims could not be substantiated.
The allegations were introduced for the first time in Supreme Court filings and were not part of the lower court proceedings. The high court typically focuses on legal questions rather than factual disputes.
Leadership Statements After 2024 Election
Following President Donald Trump’s re-election, the organization’s chief executive publicly described the result as a rejection of progressive ideology. She stated that the group was positioned to defend what she described as foundational freedoms and values.
Those remarks reflected the group’s broader mission of supporting religious liberty, traditional legal interpretations, and state authority.
Broader Legal Context
The Supreme Court is currently considering challenges to state laws that restrict transgender participation in girls sports. Similar laws have been passed in more than half of US states since 2020.
Idaho was the first state to enact such legislation, and West Virginia followed with its own statute. The court’s eventual ruling is expected to shape how states nationwide regulate athletic competition in public schools and universities.
